Most organizations that conduct charitable gaming must have IRS not-profit status. However, there are a few exceptions that don’t require an organization to acquire a 501(c) status. The exceptions are:

  1. The office may, consistent with the provisions of this Chapter, license charitable organizations, as defined in R.S. 4:703 (1), to hold and operate the following specific games of chance: (1) The game of chance commonly known as raffle or raffles played by drawing for prizes or the allotment of prizes by chance, by the selling of shares.
  2. Laws of Gambling in Louisiana. Although Louisiana’s legislature is quite developed on the side of gambling, it fails to clearly and succinctly address iGaming or online poker specifically. Historically, Louisiana has often welcomed the expansion of gambling so we may soon see more state regulated online gambling options as the laws expand to.

Alabama Raffle Laws

  1. A Mardi Gras carnival organization that has a parade permit.
  2. A civic or service association that derives less than $5,000 in gross proceeds from gaming.
  3. A booster club or parent-teacher association for a public or private nonprofit school.

Louisiana Gambling Statutes. Gambling - A.(1)(a) Gambling is the intentional conducting, or directly assisting in the conducting, as a business, of any game, contest, lottery, or contrivance whereby a person risks the loss of anything of value in order to realize a profit.

Proceeds from any charitable gaming activity (including bingos, raffles, pull-tabs, etc.) can only be used for one of the five allowed uses as set by Law. The entire net proceeds from all games of chance must be devoted to purposes that are:

  1. Educational
  2. Charitable
  3. Patriotic
  4. Religious
  5. Public spirited
